Terms of service
Last updated October 13, 2026
These terms are the agreement between you and Em for using Em. By signing in or using Em, you agree to them. If your brokerage or team has a separate written agreement with us, that agreement wins where the two differ.
1. Your account
- Em is invite only for now. You need an invitation from Em or your team leader to get an account.
- Keep your sign-in private and tell us right away if you think someone else has used it. You're responsible for what happens under your account.
- Team leaders and SuperAdmins can invite people, change roles, and turn accounts off for their team.
- You must be at least 18 and use Em for your real estate business.
2. Your data is yours
You own the contacts, notes, emails, and files you put in Em ("your data"). You give us permission to store and process your data only to run Em for you, as described in our privacy policy. You can download your data at any time, and we'll delete it within 30 days if you close your account.
You confirm you have the right to put your data in Em, including your clients' details, and that doing so follows your brokerage's policies and the law.
3. Rules for using Em
When you use Em, you agree to:
- Follow fair housing laws. Never use Em to choose, steer, market to, or treat people differently based on race, color, religion, national origin, sex, disability, familial status, or any other protected characteristic. Em will decline requests like that.
- Follow email and texting laws, including CAN-SPAM and the TCPA. Only email or text people who would expect to hear from you, honor unsubscribe, and do not contact requests, and don't send spam.
- Not misuse Em: no breaking into other accounts, scraping, overloading the service, reselling it, uploading malware, or using it for anything illegal or misleading.
We may suspend an account that breaks these rules, and we'll tell you why when we can.
4. AI and your judgment
Em uses AI to file notes, suggest who to reach, write drafts, and answer questions. It's a helper, not a professional adviser, and it can make mistakes. Check what it writes before you send it, especially dates, prices and contract details. You're responsible for what you send to clients and for your professional decisions. Nothing in Em is legal, tax, lending, or financial advice.
5. Credits and payments
- Each month your account gets credits for the things you ask Em to do (questions, drafts, texts, scans and campaigns). Monthly credits refresh on the 1st and don't carry over. The current costs are on the Credits page.
- You can buy more credits in packs. Bought credits don't expire while your account is open and are used after your monthly credits.
- Credit purchases are processed by Stripe, which acts as the seller of record and adds any sales tax. Purchases are final, except where the law gives you a right to a refund or we decide to refund one. If Em fails to finish something, the credits come back to you automatically.
- Credits have no cash value and can't be transferred or sold.
- Any subscription fees for Em are set in your or your brokerage's agreement with us. We'll give you at least 30 days' notice before changing prices.
6. The service
We work hard to keep Em running and your data safe, but we can't promise it will never be down or never have a bug. We may add, change, or remove features. If we remove something important or stop offering Em, we'll give you notice and time to download your data.
Em connects to other services (like email providers, Google, and Stripe). Their own terms apply to them, and we aren't responsible for them.
7. Ending your account
You can stop using Em at any time and ask us to close your account by emailing support@emthecrm.com. We can close an account that breaks these terms or that your brokerage no longer pays for. Either way, you can download your contacts first, and unused bought credits aren't refunded except where the law requires.
8. Disclaimers and limits
Em is provided "as is." To the extent the law allows, we disclaim warranties that it will be error free or fit a particular purpose, and we aren't liable for lost profits, lost deals, or indirect damages. Our total liability for any claim is limited to what you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.
You agree to cover us for claims that come from your data or from how you used Em in breaking these terms or the law (for example, a fair housing or spam complaint about messages you sent).
9. Law and disputes
These terms are governed by the laws of the State of Texas. If we have a disagreement, let's try to work it out first by email. If we can't, it will be handled in the state or federal courts located in Texas.
10. Changes to these terms
If we change these terms in a way that matters, we'll update the date at the top and let you know in Em or by email at least 14 days before the change takes effect. Using Em after that means you accept the new terms.
